COMPANION LIMITED REGISTRATION PURCHASE AGREEMENT

The following agreement is between "BREEDER" Bernadette Wagner, or” CBWags4u Dachsies, hereafter referred to as "Breeder" and the documented "PURCHASER or OWNER”.   In consideration of a purchase price of $ 600.00 dollars, of which $ 200.00 dollars - is non-refundable deposit, the breeder transfers in fee simple limited rights and responsibilities associated with the ownership of the Miniature Dachshund to Purchaser as of the date and time specified below.

Use of the Dog: It is agreed between breeder and purchaser that this dog is being acquired as a companion or working dog to be used for tasks appropriate to its breed such as herding, search and rescue, therapy dog.  AKC limited registration allows dogs to be exhibited in AKC, obedience, rally or agility competition events only.  The purchaser agrees that the dog is not being acquired for resale nor will it be used or trained for activities which are illegal.  Specifically it will not be used as a guard or attack dog or to hunt or fight other animals, or be bred under any circumstances.

Health: The breeder warrants the dog to be in good health as of the time of sale.  It is the customer’s responsibility to have the dog examined by a licensed veterinarian within 48 hours (not including weekends or legal holidays) of the time of transfer from breeder to the new owner to validate this agreement.  The initial health examination is also important to review the health of the dog with the customer’s veterinarian of choice.

Medical:  Should there be any genetic disease findings during the first eight years of the life of your companion – we request that you notify CBWags4u immediately of the diagnosis/onset of the illness.  By signing this agreement you are authorizing CBWags4u and its representatives to have authority to complete access all documentation/medical records for the described dachshund.   We do not provide monetary refunds.  We do not require that you return your pet to us – unless all other options are exhausted – meaning that you are asking to surrender the pet.  We will discuss with you the option of our replacing your pet – replacement is dependent upon the medical findings, and that no negligence to medical care of the sick pet occurs.  Replacement companions are completely at the discretion of CBWags4u.  We do not require the return of the companion listed in this agreement unless circumstances require you to surrender the pet to us.  Surrender of the pet disqualifies you from getting a replacement puppy!

Registration: The breeder certifies that the dog is eligible for registration under the Regulations of the American Kennel Club as a purebred Miniature Dachshund and will provide the proper forms for an AKC Limited Pet Registration under the following stipulation:  The AKC Limited Registration papers will be mailed to the Purchaser once proof (Veterinarian written statement or detailed receipt) has been provided to the Breeder that animal is either spayed or neutered.  Spay or neuter of the animal must occur prior to the age of 12 months and not earlier than the age of 6 months.  This entire agreement will be considered breeched should the date the animal is neutered or spayed fall outside the aforementioned parameters or should the dog be used for stud, or whelp a litter. 

Legal Action:  Should the Purchaser breech any of the conditions outlined in this agreement -- the Breeder reserves the right to seek legal & financial restitution for breach of this agreement, and the person named as the owner in this contract will be liable for all legal fees.  All legal matter will be addressed, heard, and decided in the Court of Shawano County, Wisconsin.

Ownership Responsibilities: The purchaser agrees to maintain the dog in a humane environment and properly train and care for it. The dog will not be allowed to roam and will be socialized and obedience trained using a non-aggressive technique. The breeder provides an AVID microchip as permanent identification, and provides the customer with paperwork to transfer ownership of this identification.  The dog will be properly licensed and inoculated against rabies, distemper, parvovirus, and other communicable diseases as recommended by a qualified veterinarian.   PLEASE NOTE:  MINIATURE DACHSHUNDS DO NOT TOLERATE THE STRAIN OF VACCINE – LEPTOSPIROSIS, and it should not be included in the inoculation– miniature dachshunds have very severe allergic reactions that can cause death.  This contract is considered breeched should the dog be inoculated with the Leptospirosis strain by the owner or the responsible party vaccinating the miniature dachshund described in this contract.

Injury / Neglect:: This guarantee will also become null and void due to any injury, accidental or unintentional, to the dog, such as but not limited to, accidents, falls, drops, drowning, choking, any type of poisoning, dehydration, heat exhaustion, endangerment due to a child or children (supervised or not), fire / flames or byproduct thereof, explosion, concussion, surgery, anesthesia, broken bone(s), convulsions, seizure, stroke, bee / wasp or other type of poisonous stings, snake or other bit, plant poisoning, drug overdose or reaction thereof (legal or illegal, canine, human or ANY other kind), kicking, throwing, hitting with something (rock, stick, bottle) etc., starvation  or poor food diet, suffocation, auto or other vehicular accident, abandonment, limited abandonment (left in vehicle alone, etc.), cruel or inhumane living conditions and / or shelter, all while in Buyer’s possession, care of, or responsibility of care due to ownership, not necessarily physical “possession”.  

Vet Bills:  Seller is NOT RESPONSIBLE for any veterinarian bills once the buyer has taken possession of animal.   

Fertility / Reproduction: This agreement will be considered breeched should your pet become pregnant, deliver, or sire a litter of puppies.

Spay & Neutering: Miniature Dachshunds which are purchased as family companions and dogs which are considered not to be of show and breeding quality.   They must be spayed or neutered when they are near sexual maturity, before the age of 1 year or 12 months of age.  Proof of spay or neuter must be provided to the breeder.  Medical information shows that neutering or spaying an animal before the age of 6 months can be detrimental to their health – it has been linked to prostate cancer in male dogs in particular – therefore we consider action to spay or neuter before the age of 6 months a breach of our contract with regards to illness, and genetic issues.

Right of Recovery/Placement:  In the event that the purchasers are unable to keep the dog or provide an appropriate home in accordance with this agreement, the dog will be returned to the breeder.  All expense for the return is the responsibility of the individual signing this contract. Purchasers agree to notify the breeder if any such contingency arises and will not abandon the dog to a shelter or sell or give the dog away. If dog is found to have been sold or given away without Breeders knowledge and said breeder discovers this – it is considered a breach of this agreement – please note the conditions described in this contract for breach of agreement.  BREEDER DOES NOT PROVIDE CASH REFUNDS – Surrender of your pet to the breeder is a financial responsibility taken on by the breeder to rescue the animal – we will provide the surrendered dog a safe, loving environment – where all of its physical and emotional needs are met, and begin emotional work for placement to another home.

All reproductive organs are presently in place, with the understanding and agreement that the pet will be spayed or neutered prior to the animal reaching the age of 1 year. 

 Note: 

This contract is binding with the signatures of both Purchaser and Breeder.  Document does NOT require both spouses to sign in order to place document into effect.  Immediately upon signature this contract becomes a legal and binding document.  No contract will be entered into with any minor under eighteen (18) years of age.  An adult sponsor (parent or legal guardian over the age of 18 years) must sign this contract for a minor in order for the purchase agreement to be legal.  The parent or guardian is bound accordingly to stipulations of this document, regardless of minor's actions.  Any “white out” or “correction fluid” used within this document nullifies the contract.  The original contract document is to be retained by the Breeder.  A copy of this contract has been provided to Purchaser.
